These Terms of Service (“Terms”) govern your use of the Firing Order Marketing website and services. By engaging Firing Order Marketing (“we,” “us,” or “our”), you (“Client”) agree to these Terms.

1. Services

Firing Order Marketing provides digital marketing services, primarily including:

Google Ads management

SEO services

Conversion tracking and analytics

Related advertising and optimization services

Services are B2B-only and tailored to service-based and technical businesses.

Unless explicitly stated in writing, services do not include sales, client closing, customer service, or business operations.

2. Engagement Structure

Services are provided on a month-to-month basis unless otherwise agreed to in writing.

Client may cancel services at any time.

No refunds are issued for services rendered or fees paid, regardless of performance or timing.

3. Payments & Billing

Payments are charged upfront and automatically billed monthly.

A 7-day grace period applies to late payments.

If payment is not received within 7 days:

Services will be paused or discontinued immediately

No obligation exists to resume work until payment is made

4. No Guarantees & Performance Disclaimer

Client understands and agrees that:

No guarantees are made regarding:

Lead volume or lead quality

Revenue or profitability

SEO rankings

Cost-per-click or ROI

Advertising and SEO results are influenced by many factors outside our control, including competition, budgets, market demand, algorithms, and client responsiveness.

Client further acknowledges that:

Websites, tracking systems, or platforms may fail, crash, or experience errors

Firing Order Marketing will make commercially reasonable efforts to diagnose and fix issues

Client must allow reasonable time and access for troubleshooting and resolution

5. Client Responsibilities

Client is solely responsible for:

All advertising spend

Ownership and funding of ad accounts

Providing accurate information, access, approvals, and timely responses

Maintaining website hosting unless otherwise agreed in writing

Firing Order Marketing acts only as an authorized manager, not the owner, of ad platforms.

6. Website & Hosting (If Applicable)

In limited cases where Firing Order Marketing builds or hosts a website:

Ownership transfers upon full payment, unless stated otherwise in writing

Websites or landing pages may be transferred via GoHighLevel or similar platforms

No documentation, training, or instructions are included unless explicitly agreed upon

7. Intellectual Property

Unless stated otherwise in writing:

Client owns:

Ad accounts

Landing pages

Ad creatives

Firing Order Marketing retains ownership of:

Internal systems

Templates

Processes

Proprietary methods

8. Communication

Primary communication is via email

Client must be available for calls when clarification is required

Meetings longer than 10 minutes must be scheduled in advance via email or scheduling link

Email-only communication is not sufficient for ongoing engagement

9. Client Interaction & Access

Firing Order Marketing:

Does not engage with Client’s customers for sales or service without permission

May communicate with Client’s employees or team members for:

Work-related clarification

Feedback

Performance insights

All such interactions will remain professional and business-related

10. Limitation of Liability

To the maximum extent permitted by law:

Firing Order Marketing is not liable for:

Lost revenue or profits

Business interruptions

Platform outages

Algorithm changes

Third-party service failures

Total liability shall not exceed the fees paid by Client in the 30 days preceding the claim

11. Termination

Either party may terminate services at any time

No refunds are provided upon termination

Outstanding balances remain due immediately

12. Dispute Resolution & Governing Law

These Terms are governed by the laws of the State of Florida

Any dispute must first be resolved through binding arbitration in Florida

Litigation is permitted only if arbitration fails or is unenforceable

13. Modifications

Firing Order Marketing reserves the right to update these Terms at any time. Continued use of services constitutes acceptance of revised Terms.
